But Derek still owns the rights to everything he did specifically for XBLA and he hasn't released that under a similar license.

Hm, that's true. But new mechanics, level-themes and generic enemies can't be copyrighted. If someone makes new sprites 'inspired' by the XBLA version it's fine. The thing that could pose a problem is uniquely identifiable characters (if there are any new ones?) At the same time, I'd say that it's close to impossible that Derek would have a problem with a demake

Well, I think we have grounds to get something started. I will start pixel arting, does anyone have the full GameMaker license and code writing capabilities? If anyone has info on new characters that would be helkpful. Also, I'm kind of new, should we start a new post?

It would be really cool if enough people got together to extend the original Spelunky. But don't just copy Spelunky XBLA. That would be lame. Make it something unique! Spelunky was one of the first indie games I played and it has a special place in my heart, and it's just plain fun.

Yeah I see what you're saying, wouldn't want to cut into the XBLA sales. Additional content and such, more levels, characters, enemies? Co-op would be cool if it were possible.

Much better to make your game. For example, I'm doing an adventure game and is also inspired by Spelunki. In no case, not a clone. Do not think. Just another game.
