It's pretty hard to convincingly play the indie card when:
1. You're smacking other indies around the head with lawsuits and demanding money from them; 2. Calling your brand hugely famous and amazingly well known.
The fact that EA's having to stand up for the 'little guys' in this case is, frankly, preposterous (despite the EA of today not being the industry devil it used to be)—this should never have gotten this far. It'll be interesting to see whether Edge manages to cling on over the next week in the App Store, but I fear it's on borrowed time again.

As Paul Eres, the last word on who is indie or not, has stated, you have to make games to be an indie developer, and there isn't any evidence that he has made games, either himself or at all for several years.
According to Ernest Adams, the grand old man of the IGDA, you don't actually have to make games to be a game developer; all you have to do is to call yourself a game developer. If you say you're a developer, then you are one! (And therefore please pay the IGDA's $50 per year membership dues; It takes a lot of cash to achieve so much inaction all at once, after all!) Period." -- Ernest Adams, IGDA founder) EDIT: And Tim's not releasing games under any pressure from publishers or outside agents, which makes him independent of their control. Hell, he's actually being sued by EA; you can't get much indier than that! So there ya go. A game developer, and independent. QED.

Right, he's sending them Cease and Desist letters (not a lawsuit), and offering to sell a license for use of the trademark. (Technically not a demand, but it's either that or change the name of your game.)

Hell, he's actually being sued by EA; you can't get much indier than that! this one sentence sort of sums up the twists, turns and bizarre nature of this whole damn thing.

As LazyWaffle alluded to, here are the options he gave Edge: One: change the name of your game to something that does not contain the word EDGE in it within the next 7 calendar days. Two: License the right to use the trademark 'EDGE' from us.
If you decide to take option 1, then we would need payment for your use of the trademark to the day you change the name. We propose 25 per cent of the revenues you have received from the game to the day you stop using our mark. If you decide to take option 2, then [you would need to add] a subtitle such as "EDGE: An Homage to Bobby Bearing" and to add our company name (EDGE Games Inc) immediately below yours in the opening screen. In other words, change the name of the game and pay Langdell 25% of all monies earned to that point, or keep the name and slap an absurd subtitle AND pay to use the mark. It takes a big man to admit he was wrong. I CAN understand the sentiment that he wanted to defend the IGDA, but he really should have researched a bit more before jumping in
