Derek Yu should use flixel and turn Spelunky into a flash game and make some money off it

Yeah, no matter how similar or different the graphics and gameplay are, the sounds are the next best thing to identical.

I'm not so sure of that. I've heard that Microsoft has some rather strict rules concerning exclusivity when it comes to XBLA. But I dunno Tongue.

Can someone make it more obvious, with an edit or something, because I can't spot the equality in the tiles.

About the sounds: they probably come from SFXR... the awesomeness grand tool for 8bit SFX.
It even has presets to generate "powerup", "coin", "jump", sounds.

They are too generic to associate them with Spelunky. My bet is that they're made with SFXR or with a custom synthesis that SFXR simulates.
I mean, most 8-bit games' coins sound like Super Mario Bros'

I can't say about the sound (can't be bothered right now going and playing both games side-by-side), but from the screenshot it's not a straight copy/paste of the Spelunky tiles. Very similar in style, yes, and perhaps lacking in originality, but not plagiarism.

You can call it out for being unoriginal in depicting cave exploration in a pixel art style, but unless they've lifted the sprite sheets (they haven't), you can't say they stole the art assets. Newsflash: Spelunky looks just like some games I was playing 15 years ago.

Setting the game in an alien flesh-cave full of Amazonian Space Boobs would have been better, though. Mmm, bouncy physics!  Durr...?

Yeah.  It doesn't look like a straight rip-and-recolor job in the examples shown, although I don't have the entire Spelunky spritesheet to compare it to...  But for example, there's at least one pillow-shaded rock in the Flash game that I doubt Derek would've drawn, and a couple of the other rocks are lit by weirdly ambiguous light sources.

Not really to defend the developer: the style's still a little too close for comfort.

I think it's more likely that he used sfxr to make the sounds. Everything made with sfxr sounds pretty similar. (like Spelunky, all of Cactus's games and my game)

If you don't believe me, download sfxr and see hear for yourself.

I think that game is clearly inspired by Spelunky, but I wouldn't call it a total rip-off. I think a simple "inspired by spelunky" in the credits would be enough acknowledgement. I don't think Derek needs to get all litigious on this guy.

It's pretty fucking lame though.

exactly. besides, even if it were a rip off, that would be a matter for derek and the guy who made this game, not a forum thread witch-hunt.
