He told me that we're pretty much clear thanks to laws regarding derivative artistic work, and the fact that neither we nor them are making money out of the stuff (well, not 100% on them).

Yeah, the big deal with derivative works is the re-use of the original piece vs. creating entirely new content based on the original work. Also, another big factor comes in with trademarks, which the original FamiCase artist has none of. A lot of his art is ripped from other works (thus his work is derivative) so making games with entirely new content based on a concept or idea that has no trademarks is perfectly fair game.

Also, in order to sue for something like using derivative work, generally you have to prove a monetary loss due to the work in question. This is what Langdell has been using to send out cease & desist letters with his Edge trademark, but he's backing himself into a hole because he hasn't released a game in so long that his trademark makes no sense. When he gets EA into court with their million dollar lawyers, they should be able to prove that he is not losing money because Mirror's Edge is sold well due to the trademark Edge (which is completely broken).

My parents said I should have been a lawyer, but I went the programming route. I also have 5 lawyers in my extended family, so if we actually do see any legal repercussion, I can ask them for legal advice.

Gotta ask some things, since I'll travel soon and prolly will end up with an unfinished game / garbage.

I know the rules aren't even out yet, but I need to ask this in advance.

First, are collaborations allowed? I think that would save whatever game I make. Splitting work will save me a lot of time.

Second, can you start sooner? I mean, 2 days sooner maybe..? Hahaha. You can mark me 2 days off the deadline if you want.

Last, can you make more than one game? Just asking this because just asking this.

100% awesome, I like how in the 60s they wer still trying to design a bright non-dystopian future(for the most part, don't look at the last pic too closely).
That said, using that in a compo would open the door to possible IP protection problems.

Those are really interesting, but I think we should focus on fake game boxes/carts. Else we'd just make a "make a game based on a picture" compo.

i really like case.game.comp

I like how it's three units of four letters, but box.game.comp is more fun to say. cart.game.comp seems like it's slightly more accurate.

I think the point is many more people will be looking at it than saying it out loud, and case.game.comp isn't exactly difficult to say. Any variation is fine with me though, i just like the style.

Just so you guys know, if you run across an image of the game: Ninja on a scooter... it's a real game. There really was a ninja on a scooter game.

Sorry, I really need to look at posting dates.  Roll Eyes Anyhoo, I may as well say: It would be really f'n cool if we had our own version of Famicase... perhaps Ataricase. Would be the same thing: Fake art on a real game cartridge case and displayed in a gallery somewhere. I should have at least 1 or 2 defunct atari games in my collection that I could use a case of. Ataricase would be so awesome. :D
