If I find some music licensed under the creative commons with the no derivatives condition, can I still use it in games, or does that count as building upon the work?

I mean, I won't modify the track itself, just play it at the appropriate time.

you're best off emailing the musician(s) and asking them if they're personally comfortable with it; if they say yes then that overrides the license

I believe you can still use it as long as you don't modify it or create another work of art out of it. Playing excerpts is fine. Please take a look at if you can use the music commercially or not (that's a very important point). But you should verify this information before proceeding.

Yeah, I'm pretty sure "no derivatives" means not to alter or remix the track, but playing it in it's pure form within another medium such as a video or a game should be fine,
safe way is to ask the artist tho, obviously
