Your game mechanic IS pretty unique though, so maybe talk to spry fox about it. afaik that was the argument they used in their case. That was not Spry Fox's argument. Spry Fox had the essential elements of their GUI stolen and the game was fairly blunt reskin. You cannot copyright a game mechanic.

You cannot copyright a game mechanic.
You can patent one, though. Just like how Sega patented corkscrew loops in Sonic games, and Namco patented loading screen mini-games.

cool advice for indies: travel back in time, hire a large legal team to put scare power behind a specious patent application

You can also write a Press release and try to make a buzz out of it. That's what most indie dev do.

Just an update on this-
As I said before, I'm not seeking any action. Just felt like venting and getting a bit of awareness out there. If you get your (relatively unknown) game copied by a studio with large publisher, the first reaction is to shout about it and get the word out.
I'm moving on from this, my game is 2 years old now and I've been working on a follow up for most of the year.
I would of been absolutely fine if they'd added some more of their own gameplay ideas. I'm a big believer in developing something new out of existing mechanics, that's a good way to innovate. So I would encourage your MegaCity/Triple Town inspired game Ryan! MegaCity is a cross between Tetris, Pipedream and Simcity itself.
The thing that bothered me is that this felt too much like a re-skinned Megacity, with precious little other influences. That and the fact it was being published by a big publisher who would probably never work with a small time one-person indie dev like myself.
But yeah, to the future. I'm working on a new game which started off as MegaCity 2 but is now completely different and mixing more genres/mechanics. I'll start a dev blog when I have something decent to show.

Looks like it work. IndieGames.com just did an article about it despite it's two years old.

You could always call it- "MegaCity 2- Fright Heights" =p.
[I don't actually advise that.]
