Imagine feeling this threatened by a game that bears no relation to your IP

first Arx Fatalis 2 was made a might and magic game and now their fan System Shock remake was renamed after 2006 shooter. At least Dishonored is not a Terminator 2099.

As we explained at the time, this is how trademark cases are often fought: it’s not about whether names are identical or overtly confusing, but more about the fact trademark law often requires lawsuits (or the threat of them) as part of the process of maintaining ownership of a name.

good job repeating a bullshit myth, kotaku

Second, Canonical is not “required” to enforce its mark in every instance or risk losing it. The circumstances under which a company could actually lose a trademark—such as abandonment and genericide—are quite limited. Genericide occurs when a trademark becomes the standard term for a type of good (‘zipper’ and ‘escalator’ being two famous examples)

Back in the medieval era, we had witches and wizards to scare the rich businesses with bullshit misinterpreted from arcane writings. Now we have lawyers to do the same thing. At least witches and wizards had cool hats.
