TechRaptor: Nintendo DMCAs Game Jolt, Takes Down 500+ Fangames
Quote
On the same day that Nintendo announced its official lineup of upcoming games for Nintendo 3DS, it seems that they wanted to clear away some of the unofficial games from the web. Indie game service Game Jolt has announced that Nintendo has hit them with a DMCA takedown notice that specified 562 separate projects that infringed on the copyrights and patents that Nintendo hold. Specifically, the Mario, Zelda, and Pokemon franchises are cited in the takedown notice, which Game Jolt have made public on GitHub. http://techraptor.net/content/nintendo-game-jolt-dmca

I never know what to think of this. I mean, it's important to protect your ip, but some things are so obviously not representing any competition with the official products that doing anything about it is just bad PR. Then again how can you check each and every single one of the hundreds of violators?

Nintendo is like an abusive partner. They hurt you for no logical reason, and then lure you back again.

In other news, I decided to get for PS4 the Banner Saga 1 & 2 bundle, The Escapists, and Invisible Inc. I've never played any of them but have been curious about them. I decided to bite the bullet and give them a go, at worst I figure maybe there is some inspiration for ideas buried in them if nothing else.

Anyone play any of these, and if so how are they?

I played the escapists for a while. It's a fun idea but for whatever reason I didn't have the patience to really get into it. It starts really slow and takes a while to understand the rules and capabilities of the game. I gave up before that. I still think it's a neat idea though! If you get passed the first 2 hours, let me know what you think.

Nintendo may have had reasons beyond pure IP protection for issuing this DMCA strike against Game Jolt. Looking into the issue, it seems that developers on Game Jolt get 30% of the ad revenue generated from any of their projects. Details of this program are laid out here, but it basically boils down to the fact that developers are making money from their use of Nintendo’s IP. We have reached out to Game Jolt regarding this policy and will update the article with a statement if it is available.

ah ok that makes it more understandable. nintendo can still fuck off tho.

I'm sorry to inform you guys that you are infringing upon my intellectual property by unlawfully quoting my post. As a creator, I have to protect my IP to retain the market value of the Silbereisen brand. Hence I, regrettably, see no other option but to permanently ban all of you.

Regards,
The Silbereisen Corporation

Back when copyright made any sense what so ever, the length of copyright terms were actually semi-reasonable. Like the US originally having 14 years + possible 14 year extension (if the original author was still alive).

If that was the case, Mario would have gone out of copyright in 2010.

But that was in the olden days. In modern times, culture moves much faster and certain symbols become part of the mainstream consciousness. So it would only make sense to have shorter terms these days. Plus it being fully legal to copy and create things for personal and non-commercial use, obviously, because that is how a living culture works.

Also, the fact that "IP" has become a commonly used term in non-legalese conversations fills me with a creeping feeling of despair.

Also, fuck nintendo. And all praise Dinsey for doing their best to ruin our culture.

no you see it's good and healthy for culture that we're stuck with a handful of corporations mainly incentivized to find new ways to sell material from half a century ago

you're being all sarcastic, but copyright law is actually a very useful institution that protects the god given right of a law abiding person such as nintendo or disney corp. to endlessly control and profit from work they had nothing to do with.
