I have a question about IGF submissions. The rule about no copyrighted materials you don't have the rights to in your entry should be pretty obvious, but I'm wondering if this applies to preview videos or trailers on YouTube or Vimeo.

Is it okay to use copyrighted music in a trailer, as long as it is NOT used in the game itself?

Not unless you get approval of the original artist and pay any applicable fees.

Given that it's hard to find a Youtube video without copyrighted music on it, I had thought it might fall under fair use as long as it's non-commercial, though I'm clearly no expert on copyright law.

My question was more about the competition rules with regards to video material not included in the entry proper, not the legality of using music in an online video in itself... but I guess it's better to err on the side of leaving even the demo video soundless until I can get something original or properly licensed on there.

this isn't really true. i've seen those too but they regularly get taken down. youtube doesn't like it any better than the IGF does.

While the Free Music Archive is certainly an option... We have a strong and talented musician community here at TIGS, and I'm sure some artists would be willing to let you use their songs for a trailers if given compensation or proper representation.

Well no, Youtube loves it because they have a system that recognises music and tries to sell it to you. They go down when someone who isn't a Youtube partner makes a complaint.
