I don't think you can copyright a person. I mean, tv shows use celebrities and politicians as characters all the time, and I'm sure they don't get permission.

You can't copyright a person. But there is an intellectual property right that celebrities have in their names and likenesses called the right of publicity. Which means that technically, Charles Barkley could still totally sue you if he wanted to.

Why don't you just use Hoopz Barkley or the Cyberdwarf? They're the only ones we know will be in the sequel anyway, so they might end up being more representative of the series.

That would fix any legal issues, but each of those characters has different attack styles too. It's fine if you would rather use kicks and punches or Gunz, but if you want to Slam/Jam, your only choice is Barkley.

I think it would be pretty pathetic to have a representative from Barkley who isn't Barkley. There is very little chance of Barkley ever hearing about this game, never mind caring enough to sue us. If you're really worried we could ask Chef Boyardee about it, but I can almost guarantee he'll tell us that Barkley never contacted him about it. Also, I wasn't posting for a while, but I did make a few stealthy edits to the OP. You might notice that we now have permission from JTR (Death Worm) and Bay 12 (Dwarf Fortress). Also, Cyber, have you emailed Yahtzee yet? Because if you haven't, I guess I'm not really scared of him anymore and I could do it.
